The wife of the immediate past Chairman of Oshimili South Local Government Council, Mrs Uche. MaryRose Ezenyili, has approached the Ubulu- Okiti Customary Court for the dissolution of her three-year old marriage with Dr Obi Kelvin Ezenyili.
The petitioner, in suit number UDCC/ 6/2024 averred that the marriage has broken down irretrievably and that she could no longer live together with the respondent as husband and wife.
Mrs Ezenyili gave other grounds for seeking the dissolution of the marriage to include that she and the Respondent were incompatible as there was lack of love between them, insisting that she found it intolerable to live with him
The petitioner, through her Counsel, Harry Ororho (Esq) also stated that she had lived apart with the Respondent for over two years, describing the Respondent as unfriendly to live with.
She, therefore, prayed the Court for an order to dissolve the marriage between her and the Respondent ,which was contracted on 18th December, 2020, under Igbo Native Law and Custom, as the marriage had broken down irretrievably.
The petitioner also prayed for an order of Court granting custody of the only child of the marriage, Miss Rita-Frances Nnedinma Ezenyili, to her as well as an order granting her leave to refund the bride price/ dowry of Ten Thousand Naira (#10,000.00) to the Respondent through the Registry of the Court.
For his part, the Respondent, Dr Obi Kelvin Ezenyili, in a cross petition, said he was opposed to the dissolution of the marriage.
The Cross Petitioner, through his Counsel, Ariomagwha Medjor (Esq), affirmed that the marriage was contacted under Ihiala Native Law and Custom. .
The case was mentioned for hearing on 30th April, 2024, at the District Customary Court Ubulu-Okiti, presided over by the Chairman, Tumbó Tamaraukuro Jane, after which it was adjourned to 14th May, 2024, for further hearing.
